These regulations govern the use of the service of Internet URL (hereafter referred to as “website”) that CUOHCO Bespoke Jewellery (hereafter referred to as “CUOHCO”) makes available to Internet users.
The use of this 'website' confers the condition of User of the website, which implies acceptance of all the conditions contained in this Legal Notice. Web site service is provided for a period of time that is limited to when the User is connected to the 'website' or any of the services offered through it. Therefore, Users must read this Legal Notice carefully every time they intend to use this 'website', since it and its conditions of use contained in this Legal Notice may change.
Some 'website' services accessible to Internet users may be subject to specific conditions, regulations and instructions that, if necessary, could replace, supplement and/or change this Legal Notice and must be accepted by the User before commencing the provision of the service.
1. Intellectual and industrial property
All contents of the 'website' -which is understood include but is not restricted to texts, photographs, graphics, images, icons, technology, software, links and other audiovisual or audio content, as well as graphic design and source code of the website itself (hereafter, the "Content")- are copyrighted by CUOHCO or third parties and are protected by current legislation on intellectual and industrial property. Access to this website can in no way be understood as conferring any rights to the User, except those which are strictly necessary to use the 'website'.
All trademarks, trade names or logos are the property of CUOHCO and it may not be construed that access to the 'website' grants the User any rights over any trademarks, trade names and/or logos.
2. Conditions of use of the 'website'
2.1 General conditions
It is expressly prohibited using the 'website' for injurious purposes against the property or interests of CUOHCO or third parties, or that, in any other way, overload, damage or disable networks, servers and other computer equipments (hardware) or products and computers applications (software).
The User undertakes to make proper use of the 'website' in accordance with the Law and this Legal Notice. The User will be liable to CUOHCO for any damages that may be caused by breach of this obligation.
2.2 Content
The User agrees to use the Content in accordance with the Law and this Legal Notice, as well as other conditions, regulations and instructions that may be applicable in each case in accordance with the provisions of this legal notice.
Including, but not limited to, User, according to the current laws, must abstain from:
- Reproducing, copying, distributing, making available, publicly communicating, transforming or modifying the Content, except for those cases permitted by law or expressly authorised by CUOHCO or by the titleholder of the corresponding rights.
- Reproducing or copying for private use the Content that could be considered as Software or Database, in accordance with current legislation on intellectual property, as well as its public communication or making available to third parties when such acts necessarily imply its reproduction by the User or a third party.
- Extraction and/or re-utilization of the whole or a substantial part of the Content of the 'website' as well as the databases that CUOHCO makes available to users.
2.3 Data Collection Forms
All the information provided by the user via the forms suggested by the 'website' should be truthful. For this purpose, the User guarantees the authenticity of any data that communicates as a result of filling the forms and will keep the information provided to CUOHCO permanently up to date so that it at all times reflects the true status of the User.
In any case, the User will be solely responsible for any false or inaccurate statements that could have made and the damage caused to CUOHCO or others for the information provided.
3. Exclusion of liability
3.1 On the information
CUOHCO shall not be liable for the decisions based on the information provided in the 'website' that the User could take or for the damages caused to the user or third parties for actions that are based solely on the information featured in this 'website'.
3.2 Use of the website
Access to this 'website' implies no duty on the part of CUOHCO to ensure the absence of viruses, worms or any other harmful computer element. It is, in any case, the Users liability to have the right tools to prevent and disinfect their system of malicious software.
CUOHCO accept no responsibility for any harm caused to users’ or third parties’ computer equipment during the provision of the 'website' services.
3.3 Availability of service
Access to the 'website' requires services and supplies by third parties, including telecommunications line and networks, whose reliability, quality and continuity of operation is not CUOHCO’s liability. Consequently, the services provided through the 'website' may be suspended, cancelled or inaccessible, prior to or simultaneously with the service of the 'website'.
CUOHCO is not responsible in any way for damages of any kind suffered by User’s or third parties’ computer equipments as a result of failures or disconnections in telecommunication networks or that cause the suspension, cancellation or interruption of 'website' services prior to or while providing the service.
4. Data protection and privacy policy
Within the framework of the current Spanish legislation, established in the Organic Law 15/1999, from the 13th December, regarding personal data protection (LOPD), data collected through the 'website' forms will be included in an automated file under CUOHCO responsibility. This entity will deal with the data confidentially and exclusively for the purpose of managing the relationship with the clients and promoting CUOHCO activities.
In the event of the data being inaccurate, incomplete or no longer necessary or relevant for their purpose, CUOHCO pledges to cancel, delete and/or block them, in accordance with the provisions of the legislation on data protection. Pressing the corresponding 'send' button of the form, the User expressly consents that their data may be used for sending commercial communications by electronic mail or by any other means.
Nevertheless, the User may oppose the sending of such communications ticking the corresponding box in every form. Furthermore, every commercial communication will indicate explicitly the procedure enabled to allow the User to oppose the sending of new commercial communications.
In the data collection forms, fields marked with an asterisk are indispensable for attending to Users request, so that, in case the user does not supply requested data, CUOHCO, in its sole discretion, may refuse the corresponding service.
Users may revoke the consent given to the use of their data and exercise all rights of access, rectification, cancellation and opposition sending a communication to CUOHCO via email.
CUOHCO meets the levels of security required by the Regulation of Security Measures approved by Spanish Royal Decree 994/1999 of 11th June. The foregoing notwithstanding, technical safety within the Internet medium is not impregnable and there still may be filtrations caused by premeditated actions on the part of third parties.
CUOHCO will be able to use cookies during the offering of the service of the 'website'. Cookies are automatic procedures for collecting information on the preferences determined by a user during their visit to a specific website. This information is recorded in small files that are imperceptibly kept in the computers equipments of the corresponding user. Every time the user accesses this website once again, these files will be automatically activated so that the website is configured with the preferences indicated in previous visits. Cookies ultimately amount to physical personal information files stored in the user's terminal and unequivocally associated with this terminal. Cookies cannot read the cookie files created by other providers.
Users may configure their browser in such a manner as to prevent the creation of cookie files or to notice the moment in which this happens.
